CRUELTY TO A HORSE
Henry Laudehr and George Laudehr, contractors, of St Kilda, were charged at the Prahran Police Court on Monday with being the owners of a horse which was found on the l4th April last to be in an unfit condition to be worked. The driver, Henry Johnston, was tried at that court for driving the horse, and he then alleged that he had either to drive the horse or be discharged from his employment. He was fined £2, but the fine was considerably reduced. He was then subpoenaed to appear against the owners, but the police had been unable to find him to serve the summons. The case had been postponed from time to time in order to produce him as a witness but he had not yet been found. The defendants now, through their solicitor, Mr Reynolds, declared that they had six weeks previous to the committal of the offence sold the horse to Johnston, and had received £5 in part payment, and they denied being the owners. Constable Evans and Sergeant Finlayson, of South Yarra, gave evidence as to the state of the horse, which was covered with sores on the day named, and that the dray drawn by the horse had the name of Laudehr Brothers painted on it. A majority of the Bench (Dr. Fetherston in the chair) declared that they were satisfied that the ownership had been proved, and fined Henry Laudehr 40s , with £6. 6s costs. The case against George Laudehr was withdrawn. Notice of appeal was given. Mr. Miller appeared for the Society for the Protection of Animals.
